This paper explores the interrelations between temporality and emotion in rhetorical argumentation. It argues that in situations of uncertainty argumentation affects action via appeals that invoke emotion and thereby translate the distant past and future into the situated present. Using practical inferences, a threefold model for the interrelation of emotion and time in argumentation outlines how argumentative action depends on whether speakers provide reasons for the exigence that makes a decision necessary, the contingency of the decision, and the confidence required (...) to act. Experiences and choices from the past influence the emotions experienced in the present and inform two intertemporal mechanisms that allow speakers and audiences to take the leap of faith that defines decision-making under uncertainty: retrospective forecasting and prospective remembering. Retrospective forecasting establishes a past–future–present link, whereas prospective remembering establishes a future-past-present link, and, together, the two mechanisms provide a situated presence that transcends the temporal constraints of uncertainty. Finally, the applicability of the model is illustrated through an analysis of a speech delivered by Danish Prime Minister Mette Frederiksen at the outset of the COVID-19 pandemic, a time where the need for decisive, yet argumentative action was crucial. The aspiration for volitional evolution, or human evolution directed by humans themselves,has increased in philosophical, scientific, technical, and commercial literature. The prospect of shaping the very being who is the consumer of all other innovations offers great commercial potential, one to which all other innovations would in effect be subservient. Actually an amalgam of projected technical/commercial developments, this prospective innovation has practical and ethical ramifications. However, because it is often discussed in a scientific way (specifically that of evolutionary theory), it (...) first calls for examination in terms of common scientific approaches to evolution. Yet, as evolutionary-theory controversies point up, evolution may be considered as neither a directed nor a directable process – a problem for the ontology of volitional evolution. One challenge for theories and programs aiming to implement the proposed innovation is then whether it is theoretically coherent. While I offer responses to the challenge in the form of objections, these in turn remain problematic. Two central issues of responsible innovation arise: (1) If this prospect were feasible, would it be responsible to implement it, and (2) if it is not even theoretically coherent, is it responsible for innovators, even this early-on, to keep promoting it as if it were? Autonomy, equality and freedom often appear to be significantly interrelated with one another. However, it has been a challenge to unite these concepts. This article attempts to take up the challenge and demonstrate how these interrelate: .

As engineers propose constructing humanlike automata, the question arises as to whether such machines merit human rights. The issue warrants serious and rigorous examination, although it has not yet cohered into a conversation. To put it into a sure direction, this paper proposes phrasing it in terms of whether humans are morally obligated to extend to maximally humanlike automata full human rights, or those set forth in common international rights documents. This paper’s approach is to consider the ontology of humans (...) and of automata and whether ontological difference between them, that pertains to the very bases of human rights, affects the latter’s claims to full human rights. Considering common bases of human rights, can these bases tell us whether a certain ontological distinction of humans from automata—or a de facto distinction about humans tacitly acknowledged by full-rights-recognizing societies—makes a difference in whether humans are morally obligated to assign these entities full rights? Human rights to security also arise. The conclusion is that humans need not be under any moral obligation to confer full human rights on automata. The paper’s ultimate point is not to close the discussion with this ontological cap but to set a solid moral and legal groundwork for opening it up tout court. (shrink)

This paper presents a computational model that integrates a dynamically structured holographic memory system into the ACT-R cognitive architecture to explain how linguistic representations are encoded and accessed in memory. ACT-R currently serves as the most precise expression of the moment-by-moment working memory retrievals that support sentence comprehension. The ACT-R model of sentence comprehension is able to capture a range of linguistic phenomena, but there are cases where the model makes the wrong predictions, such as the over-prediction of retrieval interference (...) effects during sentence comprehension. Here, we investigate one such case involving the processing of sentences with negative polarity items and consider how a dynamically structured holographic memory system might provide a cognitively plausible and principled explanation of some previously unexplained effects. Specifically, we show that by replacing ACT-R's declarative memory with a dynamically structured memory, we can explain a wider range of behavioral data involving reading times and judgments of grammaticality. We show that our integrated model provides a better fit to human error rates and response latencies than the original ACT-R model. These results provide proof-of-concept for the unification of two independent computational cognitive frameworks. (shrink)

Die Frage nach der Legitimität staatlicher Strafe ist Gegenstand einer anhaltenden und bisweilen ausufernden Diskussion, die inzwischen eine kaum noch überschaubare Fülle von Texten im rechts- und moralphilosophischen, staatstheoretischen und strafrechtlichen Schrifttum hervorgebracht hat. Mit Benthams utilitaristischem Prinzip des größten Glücks der größten Zahl und des im Retributivismus entscheidenden intrinsischen Unwertes der Tat als Anknüpfungspunkt der Strafe sowie dessen prominentesten Vertreter Kant werden die verschiedenen Strafkonzeptionen vorgestellt - einschließlich jenen, in denen beide Elemente miteinander verknüpft sind - wie etwa im (...) Strafziel der Resozialisierung. Darüber hinaus werden die unterschiedlichen staatstheoretischen Modelle, die dem utilitaristischen und retributivistischen Ansatz entsprechen im einzelnen entfaltet. Die Anwort auf die Frage nach der Vereinigung der Zweckbestimmungen staatlichen Strafens mit den fundamentalen Vorstellungen über Freiheit, Verantwortlichkeit, Schuldfähigkeit und damit Personalität, wie sie innerhalb des gedanklichen Horizontes einer staatlichen Gemeinschaft konsensfähig sind, bleibt jedoch zwangsläufig offen. Is the Kantian basis of valuing in humanity sufficient or sound enough to account for all valuing? At least two other such bases have been proposed across the ages, that of the sentiments and the valuing of life itself. This article focuses on the Kantian view, the first of these three possible bases of valuing. The concern is: by which criteria can we assess whether a given theory of or approach to basing a value is in fact usable and optimal, (...) that is can in fact explain why a value can be assuredly based on a theory of value. That is, can a possible theory of value indeed explain all other values? That is, it seems a “meta” analysis of the situation is due. The article looks to five perspectives on the Kantian concept of humanity to determine if that humanity, as a theory of all valuing’s bases, is at least supportable / sustainable, if not yet sufficiently fleshed out. The article concludes that these five perspective may each and severally leave some cogent doubt of humanity as the basis of all other value, while leaving unsettled the possibility the perspective is flawed or is not thorough enough for due criticism of humanity as basis. This narrative commentary on Nietzschean ambitions, in part influenced by Zarathustra and Ecce Homo, centers on a long, ongoing, expansive, and highly imaginative technological projects by two men, Stuart Beholt and Alby Tolby. Having worked up adventurous software in university days, their experiences interwoven with their friendship bring out a panoply of current philosophical issues--and beyond. This narrative philosophy evokes and explores more issues than current philosophical debates concerning emerging technologies can include in a more conventional work. At the same (...) time, this structure makes the read readily accessible , including such issues as the intriguing recent flirtation of religion and materialism that have only been broached in the literature. At the same time, high finance and monetary issues, besides the alluring beauty of solving tremendous engineering problems, pull the two übermensch into ever greater schemes, well evoking the question of the limits of ethics and epistemology. This philosophical narrative delves into deepening crises afflicting modern democracies, when extreme inequality and its resultant alienation grips not just adults but, even more anguishingly, children. These children and often their parents come in far under the social radar, so out-of-touch that even census takers overlook them. In this milieu, weapons and narcotics are as much an unquestioned part of life as breathing. The world beyond this invisible cage entirely escapes them, nor does the larger society miss them or know (...) about them. This documentary narrative follows a thirteen-year-old who forces himself to escape his oblivious father, not out of hope, but for sheer escape from the execrable situation, without even the will to be himself, whatever that is. He also must navigate through his nightmare existemce, relying on an illicit business, the only thing he knows as well as breathing. If the individuals in this milieu--which cut across racial boundaries--ever even hear of voting, they are drawn to strong-arm politicians, who appeal to these scattered inhabitants, as examples of strength, no-nonsense, even hatred. The ethics of such circumstances' mere existence--further extreme than even those in Les Miserable--in our societies poses a formidable challenge to the ethics of social and political philosophy and are hardly touched upon in the academic literature. The central philosophical question is whether it is possible for a political system to preempt such conditions, particularly when these individuals, especially the children, are veritably invisible. The metaphilosophical issue is why philosophy does not focus more concern about this ignored human morass. To say an indictment of soiciopolitical philosophy is not justified here, that the persons encountered here are merely messed-up self-indulgent people, only adds cause to the charge. (shrink)

Since the Nuremberg Code and the first Declaration of Helsinki, globally there has been increasing adoption and adherence to procedures for ensuring that human subjects in research are as well informed as possible of the study’s reasons and risks and voluntarily consent to serving as subject. To do otherwise is essentially viewed as violation of the human research subject’s legal and moral rights. However, with the recent philosophical concerns about responsible robotics, the limits and ambiguities of research-subjects ethical codes become (...) apparent on the matter of constructing automata that maximally resemble human beings (as defined hereunder). In this case, the automata themselves, as products of research and development, are in the very process of their construction subjects of research and development. However, such research faces a paradox: The subjects cannot give their informed consent to this research for their own development, although their consent would be needed for the research. According to ethical codes, this research would be unethical. The article then explores whether the background concepts giving rise to this paradox could be reframed in order to allow such research to proceed ethically. (shrink)

Many of Margaret Cavendish’s criticisms of Thomas Hobbes in the Philosophical Letters (1664) relate to the disorder and damage that she holds would result if Hobbesian pressure were the cause of visual perception. In this paper, I argue that her “two men” thought experiment in Letter IV is aimed at a different goal: to show the explanatory potency of her account. First, I connect Cavendish’s view of visual perception as “patterning” to the “two men” thought experiment in Letter IV. Second, (...) I provide a potential reply on Hobbes’s behalf that appeals to physiological differences between perceivers’ sense organs, drawing upon Hobbes’s optics in De homine. Third, I argue that such a reply would misunderstand Cavendish’s objective of showing the limited explanatory resources available in understanding visual perception as pressing when compared to her view of visual perception as patterning. This paper uses a study of the life story narratives of former classmates of Dutch and Moluccan descent to argue that the constructionist approach to intersectionality, with its account of identity as a narrative construction rather than a practice of naming, offers better tools for answering questions concerning intersectional identity formation than a more systemic intersectional approach. The case study also highlights the importance of the quest for origins in narratives. It demonstrates that theories of intersectionality are unjustified in subsuming (...) the issue of belonging under the identity marker of ethnicity, when all identities are performatively produced in and through narrative enactments that include belonging. Belongingness is a precarious achievement. The case study illustrates that if narrative accounts of a life fail to achieve narrative closure regarding roots, attempts to trace routes are seriously hampered. (shrink)

Following in a psychological and musicological tradition beginning with Leonard Meyer, and continuing through David Huron, we present a functional, cognitive account of the phenomenon of expectation in music, grounded in computational, probabilistic modeling. We summarize a range of evidence for this approach, from psychology, neuroscience, musicology, linguistics, and creativity studies, and argue that simulating expectation is an important part of understanding a broad range of human faculties, in music and beyond.

Over the past several decades environmental ethics has grown markedly, normative ethics having provided essential grounding in assessing human treatment of the environment. Even a systematic approach, such as Paul Taylor’s, in a sense tells the environment how it is to be treated, whether that be Earth’s ecosystem or the universe itself. Can the environment, especially the ecosystem, as understood through the study of ecology, in turn offer normative and applied ethics any edification? The study of ecology has certainly increased (...) awareness of the fact that it is not possible for a moral agent within the ecosystem to step outside its intricate mesh of actions and events, of causes and effects. That is, absolutely everything that an agent can do can have some, often unforeseeable, outcome in the environment. An incompletely snuffed-out match tossed out a car window can cause a forest fire, which causes biome destruction, which causes x, y, and z. In sum, the ecosystem can edify ethics in terms of the scope of ethics, which remains an unsettled, if too-often ignored, matter. By such an inclusive view of moral scope, as derived in part from ecology and as presented here, the scope of moral behavior would include—whether or not adventitiously—every action an agent may do. By this view, moral scope is, in essence, unlimited. The article offers some ramifications of this view of moral scope. (shrink)

This article argues that existing approaches to programming ethical AI fail to resolve a serious moral-semantic trilemma, generating interpretations of ethical requirements that are either too semantically strict, too semantically flexible, or overly unpredictable. This paper then illustrates the trilemma utilizing a recently proposed ‘general ethical dilemma analyzer,’ GenEth. Finally, it uses empirical evidence to argue that human beings resolve the semantic trilemma using general cognitive and motivational processes involving ‘mental time-travel,’ whereby we simulate different possible pasts and futures. I (...) demonstrate how mental time-travel psychology leads us to resolve the semantic trilemma through a six-step process of interpersonal negotiation and renegotiation, and then conclude by showing how comparative advantages in processing power would plausibly cause AI to use similar processes to solve the semantic trilemma more reliably than we do, leading AI to make better moral-semantic choices than humans do by our very own lights. After years of activism and scholarship concerning patriarchal social structures, many contemporary societies have made substantial progress in women’s rights. The shortfall, and the work ahead, is well known. Even in societies where the most progress has been achieved, males continue to dominate at key levels of power. Yet, essentialism appears to be widely, although not yet entirely, discounted. In helping to illuminate the social ontology of patriarchy and thereby helping to defuse its injustice, scholars have made proposals of patriarchy’s (...) origins; however, these appear not to be optimally consistent with historical and prehistorical facts. This article offers a different account of patriarchy, arguing that this one can not only explain how such a social condition originated and why it persists, but also point to what may be necessary to do in order to undo it. While I do not contend this ontology of patriarchy is the best possible, it provides a good example of the many issues at stake which an account of patriarchy must explain and points to how we should seek the best ontology as a way of both understanding contemporary societies and suggesting how to rectify a long-standing injustice. Utilizing the definition of phenomenology originally presented by Edith Stein, it is possible to understand Viktor Frankl's existential psychotherapy as falling well within the phenomenological movement. In this article, Frankl's approach to treatment, which utilizes an induced phenomenological struggle, is examined in detail around its relationship with time. Clinical material is presented to illustrate the described treatment approach.

There is a vast amount of evidence across countries that the use of health care services (including hospitalizations, physician services, and clinical preventive services) is positively associated with income, education and other markers of socioeconomic position. In some analyses, lower socioeconomic status (SES) is associated with greater physician and hospital use, although it appears that these findings are primarily driven by higher rates of poor health status or medical need in socioeconomically disadvantaged populations. Three general sets of explanations have been (...) investigated to explain SES differences in health care use: (1) financial access or affordability differences (e.g. the poor use fewer services because they have fewer financial means); (2) knowledge, attitudinal and cultural differences in seeking care (e.g. the poor use fewer services because they value and/or understand the benefits of health care less than other people); and (3) health care system factors (e.g. the poor use fewer services because of ways in which the health care system is organized). The empirical evidence from a number of countries suggests that health care system variables, especially non-financial components of access, offer the greatest explanatory power regarding SES differences in utilization. The policy implications of such findings are important, for they suggests that providing universal coverage or offering free health services to the poor is not a panacea for reducing social inequalities in health care utilization. Research across countries also suggests that, although SES differences in the use of health care services may contribute to some portion of observed SES disparities in health status, the contribution here is likely to be small. Social inequalities in health status are driven by myriad factors other than access to and use of personal health services. (shrink)

We argue that many intuitions do not have conscious propositional contents. In particular, many of the intuitions had in response to philosophical thought experiments, like Gettier cases, do not have such contents. They are more like hunches, urgings, murky feelings, and twinges. Our view thus goes against the received view of intuitions in philosophy, which we call Mainstream Propositionalism. Our positive view is that many thought-experimental intuitions are conscious, spontaneous, non-theoretical, non-propositional psychological states that often motivate belief revision, but they (...) require interpretation, in light of background beliefs, before a subject can form a propositional judgment as a consequence of them. We call our view Interpretationalism. We argue (i) that Interpretationalism avoids the problems that beset Mainstream Propositionalism and (ii) that our view meshes well with empirical results in contemporary cognitive science. (shrink)

Currently, some philosophers and technicians propose to change the fundamental constitution of Homo sapiens, as by significantly altering the genome, implanting microchips in the brain, and pursuing related techniques. Among these proposals are aspirations to guide humanity’s evolution into new species. Some philosophers have countered that such species alteration is unethical and have proposed international policies to protect species integrity; yet, it remains unclear on what basis such right to species integrity would rest. An answer may come from an unexpected (...) angle of rights issues: Some cultures have indicated that they want no part of our technological culture, preferring to retain their practices. Yet, rights documents do not explicitly establish that any individual has a right to species integrity. Careful interpretation of rights documents nonetheless reveals that such a right to species integrity is implicit. Interpreting these so as to reveal this needed right is also necessary to retain the foundations of rights documents and institutions. Further, acknowledging a right of species integrity could mean, because of practicalities, a limit to the freedom of proponents to implement proposals to manipulate the species. (shrink)

This article discusses the viability of a feminist constructivist approach of knowledge through the careful reading of the work of the feminist scholar and historian of science and technology, Donna Haraway. Haraway proposes an interpretation of objectivity in terms of "situated knowledges. " Both the subject and the object of knowledge are endowed with the status of material-semiotic actors. By blurring the epistemological boundary between subject and object, Haraway's narratives about scientific discourse become populated with hybrid subjects/objects. The author argues (...) that the ethics of these hybrid subjects consists of an uneasy mixture of a Nietzschean and a socialist-Christian ethic. The article concludes by setting out why Haraway's project constitutes an inter esting effort tofuse postmodern insights and feminist commitments. (shrink)

While in recent years new charters and government actions have boosted the collective and individual rights enjoyed by “Fourth-World” indigenous peoples such as the Inuit, another set of indigenous peoples has not experienced such protection: “self-delimiting” peoples. Their rights go largely unprotected because of deliberate ambiguities in the word “indigenous”; because these peoples generally avoid all contact with the larger society, and so are unknown by it and have no voice in it; and because charters and institutions generally require validation (...) of an indigenous people as bona fide—such as a history of contact and of evident land occupation—in order for the group to enjoy full rights protections. Both practice and theory may militate against the extension of full protection. This paper argues that theory, institutions building upon it, and practice realizable from theory and institutions must be reconsidered in terms of the particular circumstances and needs of these peoples if their rights are to be fully respected and maintained. Clear, special protection for these peoples’ rights to their culture must be established. (shrink)

I claim that there is pro tanto moral reason for parents to not raise their child on a vegan diet because a vegan diet bears a risk of harm to both the physical and the social well-being of children. After giving the empirical evidence from nutrition science and sociology that supports this claim, I turn to the question of how vegan parents should take this moral reason into account. Since many different moral frameworks have been used to argue for veganism, (...) this is a complex question. I suggest that, on some of these moral frameworks, the moral reason that some parents have for not raising their child on a vegan diet on account of this risk is plausibly as strong as the reason they have for raising their child on a vegan diet. In other words, the moral reason I outline is weighty enough to justify some vegan parents in plausibly finding it permissible to not raise their child on a vegan diet. (shrink)
